More volume and more brands importing from China and other APAC manufacturers mean more regulatory scrutiny at the border. As the FDA explains, imported cosmetics are subject to review at the time of entry through US Customs, and products that do not comply with FDA laws “are subject to refusal of admission into the United States.” For an importer, a single hold at customs can wipe out an entire launch window. Does Cosmetic Packaging Need FDA Approval? US Rules Explained

The most common misconception in sourcing is that “FDA-approved” packaging exists. It does not. Under the Federal Food, Drug, and Cosmetic Act (FD&C Act), cosmetic products and ingredients — other than color additives — do not require FDA pre-market approval. What the law actually prohibits is marketing adulterated or misbranded cosmetics, and packaging plays a direct role in the adulteration test.

A cosmetic is adulterated if “its container is composed, in whole or in part, of any poisonous or deleterious substance which may render the contents injurious to health.”

In practice, the container provision means the brand owner — not the glass factory — carries the legal responsibility to substantiate that the packaging material is safe in contact with the formula. In addition, under the Modernization of Cosmetics Regulation Act (MoCRA), facilities that manufacture or process cosmetic products distributed in the US must register with the FDA and renew that registration every two years; an initial registration on 20 February 2024, for example, must be renewed by 20 February 2026. If your brand manufactures or fills cosmetics in the US, registration is your responsibility. If you import finished goods, verify that your contract manufacturer is registered before you sign.

So what should you ask a packaging supplier for in the US context? Request a written material compliance statement for each component — glass body, cap, liner, gasket, pump — confirming the material is safe for cosmetic contact and free of substances that could migrate and adulterate the product. Many experienced suppliers, such as those producing luxury glass lotion bottles, provide material specifications and test data with the sample request so their customers can complete their own safety substantiation.

REACH Compliant Cosmetic Packaging: EU and SCIP Rules

For cosmetic packaging certifications, the European Union takes a stricter approach than the US. REACH is the EU’s main regulation on chemicals, and while cosmetic formulas are regulated under the EU Cosmetics Regulation, cosmetic packaging is assessed separately because bottles, caps, pumps, applicators, cases and boxes are treated as “articles” under REACH. As EcoMundo notes in its SCIP guidance, if an article contains a Substance of Very High Concern (SVHC) from the Candidate List above 0.1% weight by weight, information duties apply — and since 5 January 2021, suppliers placing such articles on the EU market must also notify them into ECHA’s SCIP database, established under the Waste Framework Directive.

This is where composite packaging gets interesting. A single airless pump bottle can contain a glass or plastic body, a polypropylene piston, a stainless spring, and rubber or silicone gaskets — each a separate material stream that could, in theory, carry an SVHC. RoHS Certifications and California Prop 65: Extra Requests from Buyers

Two more cosmetic packaging certifications appear constantly in buyer requirement sheets. The first, RoHS, is frequently misunderstood. Strictly speaking, the EU RoHS Directive restricts ten hazardous substances — lead, cadmium, mercury, hexavalent chromium, PBBs, PBDEs and four phthalates — in electrical and electronic equipment, so empty cosmetic packaging sits outside its legal scope. In practice, however, US and EU buyers frequently request RoHS-style heavy metal test reports for plastic parts, coatings and printing as a fast, affordable screen for the same restricted substances. Treat it as a due-diligence benchmark, not a legal requirement for packaging, and ask for the report’s test method and scope in writing.

The second is California’s Proposition 65, a state law that requires businesses to provide warnings before exposing people to chemicals on the Prop 65 list — a list first published in 1987 and updated at least once a year, covering substances linked to cancer or reproductive harm. As the official Prop 65 FAQ explains, a business does not need a warning if exposure poses no significant risk, but penalties for missing warnings can reach USD 2,500 per violation per day, and enforcement can come from the California Attorney General or private plaintiffs. For packaging buyers, the practical exposure points are heavy metals such as lead and cadmium that can appear in glass and decorated finishes, and phthalates used in soft plastics. Ask your supplier whether any component contains Prop 65-listed chemicals above safe harbor levels — and keep the answer on file.
